Terms & Conditions for HackArambh

HackArambh ("we," "us," or "our") operates the website https://hackarambh.com/ (the "Site"). These Terms & Conditions ("Terms") govern your access to and use of the Site and our services, including participation in competitions, coding challenges, idea submissions, mentorship programs, and prize distributions (collectively, the "Services"). By accessing the Site, registering an account, or participating in any Services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or Services.

We may update these Terms at any time. The updated version will be posted here with a revised effective date. Continued use after changes constitutes acceptance. Significant updates will be notified via email or a Site announcement.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services independently. If you are under 18, you must have verifiable parental or guardian consent and supervision. By using the Services, you represent that you meet these requirements and are not barred from using the Services under applicable law.

We reserve the right to refuse or terminate access to anyone for any reason, including suspected violations of these Terms.

2. Account Registration and Security

To participate in competitions or access certain features, you may need to create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized use.
Be solely responsible for all activities under your account.

We are not liable for losses due to unauthorized access if you fail to secure your account. You may not share accounts, use automated tools to create multiple accounts, or impersonate others.

3. Competition Participation

3.1 Registration and Submissions

Competitions may require entry fees (processed securely via third-party providers). Refunds are not offered except as specified in the competition rules.
Submissions (e.g., code, prototypes, ideas) must comply with the specific competition guidelines posted on the Site. Late or incomplete submissions are ineligible.
By submitting, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and promote your submission for marketing and educational purposes (e.g., showcasing winners). You retain ownership of your submission.

3.2 Evaluation and Selection

We, along with judges, mentors, and partners, will evaluate submissions based on criteria outlined in the competition rules (e.g., innovation, feasibility, technical quality).
Decisions are final and not subject to appeal. We reserve the right to disqualify entries for non-compliance, plagiarism, or unethical conduct.
Participants agree to provide feedback or additional materials if requested.

3.3 Team Participation

Teams must designate a lead representative. All team members must agree to these Terms.
Prizes are awarded to teams, but distribution is at our discretion.

4. Intellectual Property

The Site and Services, including text, graphics, logos, and software, are owned by us or our licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written permission.

Your submissions remain your property, but you grant us the limited license described in Section 3.1. You represent that your submissions do not infringe third-party rights. We are not liable for any infringement claims arising from your content.

5. User Conduct and Prohibited Activities

You agree to use the Services only for lawful purposes and in compliance with these Terms. Prohibited activities include:

Uploading harmful content (e.g., viruses, malware).
Harassing, defaming, or discriminating against others.
Reverse-engineering, scraping, or unauthorized data collection.
Commercial use without permission or spamming.
Violating competition rules, such as cheating or submitting plagiarized work.

We may monitor usage and remove content or suspend accounts for violations. You agree to indemnify us against claims arising from your misuse.

6. Prizes and Winners

Prizes (e.g., cash, mentorship, gadgets) are non-transferable and subject to verification. Winners must claim prizes within 30 days.
Taxes on prizes are your responsibility. We may require tax forms (e.g., W-9 for U.S. residents).
We are not responsible for lost, delayed, or undeliverable prizes due to incorrect contact information.

7. Disclaimers and Limitations of Liability

7.1 Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted access, error-free operation, or that submissions will win.

Participation in competitions involves risks, including potential public exposure of ideas. Use at your own risk.

7.2 Limitation of Liability

To the fullest extent permitted by law, we, our affiliates, and partners shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Services, even if advised of the possibility. Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

8. Termination

We may suspend or terminate your account and access to the Services at any time, with or without notice, for violations of these Terms or for business reasons. Upon termination, your right to use the Services ends, but Sections 4, 5, 7, 8, 10, and 11 survive.

You may terminate your account by contacting us, but ongoing competition obligations remain.

9. Force Majeure

We are not liable for delays or failures due to events beyond our control, such as natural disasters, strikes, or pandemics.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of [City, e.g., Mumbai], India.

You agree to first attempt informal resolution by contacting us. If unresolved, you waive jury trials and class actions.

11. Miscellaneous

These Terms constitute the entire agreement. If any provision is invalid, the remainder remains enforceable. No waiver is a continuing waiver. You may not assign these Terms without our consent; we may assign freely.
